Privacy policy

Zenith Concierge (“we”, “us”, or “our”) provides buyer-exclusive representation and concierge services for purchasing real estate in Spain. This Privacy Policy explains what personal data we collect, how we use and share it, and the rights you have. It applies to our website and all Zenith Concierge services.

We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and Spain’s Organic Law 3/2018 on Data Protection (LOPDGDD).

1. Information we collect

We collect the following when you contact us, book a consultation, or engage our services:

• Identity and contact data: name, email address, phone number, country of residence, and nationality.
• Transaction data required for property purchases: passport or ID number, NIE, residency status, and the information notaries, lawyers, and financial institutions require to complete a purchase.
• Financial and engagement data: budget, financing capacity, property preferences, and information relating to payment of our fees.
• Usage data: device type, IP address, browser, pages visited, and access times.

2. How we use your information

• To provide, maintain, and improve our buyer-representation services.
• To communicate with you, respond to enquiries, and coordinate consultations and viewings.
• To coordinate property search, negotiation, and purchase with our local partners.
• To comply with legal, tax, and anti-money-laundering obligations.
• To prevent fraud and maintain security.
• To run analytics that improve the website and services.

Legal bases (GDPR): performance of a contract, your consent (which you may withdraw at any time), compliance with legal obligations, and our legitimate interests in delivering and improving the services.

3. How we share your information

To deliver our services, we may share your data with:

• Licensed Spanish real estate agents we subcontract for property search and viewings.
• Lawyers, gestores, and notaries involved in due diligence and completing the purchase.
• Financial institutions and mortgage advisers, where you request it.
• Service providers (web hosting, email, analytics, appointment scheduling) acting on our behalf.
• Public authorities where required by law.
• Third parties in a corporate transaction (merger, acquisition, or asset sale).

We do not sell your personal data. We may share aggregated or anonymized information that cannot identify you.

4. Cookies and tracking

We use a small number of cookies. Two are strictly necessary and are always set. The rest are analytics tools that load only if you click Accept on the cookie banner. If you click Reject, none of them load.

PostHog records how pages are used (pages viewed, clicks, scrolling and mouse movement) so we can see which parts of the site are unclear. Anything you type into a form is masked and never recorded, your IP address is discarded, and recordings are kept for up to 30 days. PostHog stores this data in the European Union (Frankfurt) and acts as our processor under a data processing agreement.

To change your choice, delete the zenith_cookie_consent cookie in your browser settings; the banner will appear again on your next visit.

5. How we protect your information

We apply reasonable technical and organizational measures to safeguard your data: encryption in transit (SSL), access controls, and restriction to personnel with a legitimate need. No system is completely secure; in the event of a breach affecting you, we will notify you and the relevant authorities as required by law.

6. Data retention

We retain your data for as long as necessary for the purposes described, and afterwards for the period required by tax, accounting, and anti-money-laundering rules (up to ten years in certain cases in Spain). You may request deletion subject to these legal obligations.

7. International transfers

Zenith Concierge serves international clients and operates through a US-incorporated entity (a Wyoming LLC). Where we transfer data outside the European Economic Area, we do so with appropriate safeguards, such as the European Commission’s Standard Contractual Clauses.

Our website is hosted by Hostinger on servers in the United States. Website analytics collected by PostHog are stored in the European Union.

8. Your rights

Under the GDPR, you have the right to:

• Access your personal data and obtain a copy.
• Rectify inaccurate or incomplete data.
• Request erasure (the “right to be forgotten”).
• Restrict or object to processing.
• Request portability of your data.
• Withdraw your consent at any time.
• Lodge a complaint with the Spanish Data Protection Agency (AEPD, www.aepd.es).

9. Children’s privacy

Our services are not directed to anyone under 16, and we do not knowingly collect their data. If we learn we have received a minor’s data, we will delete it promptly.

10. Accessing and modifying your information

You may request access to, updates to, or deletion of your information by contacting us. You can opt out of marketing communications at any time; operational communications relating to an engaged service will continue.

11. Changes to this policy

We may update this Privacy Policy from time to time. We will post the revised version on this page with a new “Last updated” date. Continued use of the site after such changes constitutes acceptance.
